§ 16. [REPRESENTATIVES' OATHS]

The Representatives having met, and chosen their Speaker and Clerk, shall each of them, before they proceed to business,
take and subscribe, as well the oath or affirmation of allegiance hereinafter directed (except where they shall produce
certificates of their having theretofore taken and subscribed the same) as the following oath or affirmation:

You do solemnly swear (or affirm) that as a member of this Assembly,
you will not propose, or assent to, any bill, vote or resolution, which shall appear to you injurious to the people,
nor do nor consent to any act or thing whatever,
that shall have a tendency to lessen or abridge their rights and privileges, as declared by the Constitution of this State;

but will, in all things, conduct yourself as a faithful, honest Representative
and guardian of the people, according to the best of your judgment and ability.

The legislators listed in each of the bills below, either, proposed, assented to, or voted on, MULTIPLE acts in violation of the Vermont Constitution, by writing, proposing, sponsoring, and passing (H.735), gun control legislation to lessen and abridge the rights of Vermonters to self defense, private property ownership and protection from unwarranted search and seizure under the Vermont Constitution.

No gun control legislation is legal in Vermont as the very concept of restricting, regulating, banning, licensing, or prohibiting a Constitutional Right is a direct violation of the Vermont Constitution, the Sportsman's Bill of Rights, and the legislator's OATH OF OFFICE.


Many of these SAME legislators are running AGAIN in 2014 to CONTINUE to push gun control in Vermont.

Be informed, know the truth, know the law, and REMEMBER IN NOVEMBER: No more gun control.

Vermont Anti-Firearm Legislation 2013-2014 Session (Violation of Article 16) Details:
Bill: H.0124Title: An act relating to firearms regulation
Prohibit the manufacture, possession, or transfer of large capacity ammunition feeding devices (making existing owners felons because magazines do not have date stamps on them).
Once the original owner dies, the firearm must be turned over to the autorities or the new owner will be in possession of an illegal firearm, and now a felon.
Mandating "safety" courses for ALL persons who carry concealed (precursor to full licensing, as only "approved" persons can carry concealed, any other person is a criminal).
Labeling citizens as "approved" to carry is in DIRECT VIOLATION of Article 16 of the Vermont Consitution.
There is NO restriction on "who" can carry firearms in Vermont.
Vermont is the ORIGINAL "Constitutional Carry" State, and it has served us well for over 200 years.

Bill: H.0125Title: Internal security and public safety; disposition of unlawful firearms; firearm safety training
Creates a state-run facility to store confiscated firearms before destruction, creates a privately run safety training program (to fulfill the licensing of persons carrying firearms in H.124), allows the private center for Officer and State officials to be used as an indoor firing range.

Bill: H.0243Title: Crimes; weapons; negligent storage of a firearm
Bill makes it a crime for a "person" (not necessarily the gun OWNER) to negligently leave a firearm accessible to a child.
All penalties are felonies, barring said person from possession of firearms as long as they live.

Require a mandated 48-hour waiting period for all gun sales by dealers (would eliminate the "gun show" trade overnight).

Bill: H.0336Title: Crimes; firearms; use in felony; reckless endangerment
Raises Reckless Endangerment to a felony, even if by accident, or the gun is UNLOADED and no harm could have been done.
Anyone charged with this crime is barred the possession of firearms as long as they live.
A person committing a crime while carrying a firearm (whether or not they USE the firearm) automatically receives between 5-10 years in prison.
Laws that ALL prohibit firearms ownership (whether by accident or intent).

Bill: H.0413Title: Crimes; Uniform Collateral Consequences of Conviction Act
If convicted, or plead guilty, person will suffer ADDITIONAL penalties beyond prison; home confinement, probation, fines, inability to get licenses, permits, jobs, welfare or goverment subsidies, housing, having the government take your property, losing the right to own a firearm and losing the right to vote if you move to another state!
Does not allow any person accused to invalidate a plea, conviction, or sentence; judgement is final and irrevocatble (even if wrongly convicted).
Draconian law that cannot be challenged.

Bill: H.0467Title: Criminal procedures; firearms; Department of Mental Health reporting
Mandates the State notify the National Instant Criminal Background Check System when a person is treated for mental illness, whether hospitalized or not hospitalized, so that the person will now appear as a "Prohibited Person" (ie. felon) and will be forever barred the possession of firearms.
There is currently, no way out of the NICS even if the person is no longer a threat, or found not to be mentally ill.
If a gun owner receives treatment for ANY mental condition, such as stress or anxiety, they lose their rights.
This type of law is CONTINUOUSLY updated with new restrictions and clauses.

Bill: H.0706Title: Crimes; possession of dangerous or deadly weapons on school property
Prohibiting the possession of firearms and other dangerous or deadly weapons on any school property, which includes knives, baseball bats, metal rods, axes, etc, would have TWO MAJOR EFFECTS:
1. The right of every Vermonter to carry a firearm or other weapon for self defense will be outlawed.
Parents could not pick up or drop off their children at school, administrators and teachers will likewise be prohibited from travelling to and from their job while protected.
NO ONE WILL BE ARMED WHEN THE NEXT KILLER WALKS BY THE "GUN-FREE ZONE" SIGN...
This is a VERY BAD procident to set.
2. Hunting in the State of Vermont will virtually cease.
THOUSANDS of acres of hunting land are "owned" by schools and colleges in Vermont.
Travelling by, or near a school will become illegal for any road crews that carry dangerous tools.

Bill: H.0735Title: Executive Branch and Judiciary fees
This is the most contentious bill in recent memory.
It was pushed, and passed as a "fee" bill, while creating a new section of Criminal Law under Section 20 V.S.A.
This law mandates the court to confiscate firearms, ammunition and dangerous weapons, from anyone ACCUSED of domestic abuse.
The accused then is required to PAY FEES TO THE STATE for the storage of said items when the court deems them to be returned.
The law does not recognize a search warrant being needed, nor a court appearance.
This law violates the Vermont Constitution under the following: Article 9, Article 10, Article 11, Article 12, Article 16.

Bill proposes to prohibit a person convicted of a violent felony from possessing a firearm, unless you are licenced dealer, importer or manufacturer, then you can still possess firearms.

Mandates ALL healthcare providers to report attending or treating a case of bullet wound, gunshot wound, powder burn, or any other injury arising from or caused by the discharge of a gun, pistol, or other firearm to local law enforcement or the State Police.

Bill: S.0032Title: Crimes; weapons; possession of semiautomatic assault weapons and large capacity ammunition feeding devices
This bill proposes to prohibit the manufacture, possession, or transfer of semiautomatic assault weapons and large capacity ammunition feeding devices; and to make it a crime for a person to negligently leave a firearm accessible to a child.
SEMIAUTOMATIC ASSAULT WEAPON BAN by function, type and model: (See Feinstein gun ban listing)
FIVE ROUND MAGAZINE LIMIT on internal mags, TEN ROUND MAGAZINE LIMIT on detachable mags.
Ban on all firearms with 2 or more "features" (See Feinstein gun ban).
Ban on ALL semi-automatic pistols (by definition all pistols have magazines that attach outside the grip).
Same "Negligent Storage" proposal as H.243 including felony charges.
Also mandates pawn shops to keep "Gun Registry" of personal buyer/seller information for 6 years available to law enforcement at all times.

This is illegal for the State to do on their own, but they can use this data and create their own without violating the Federal ban.
